Department of Labor Announces 2023 Civil Monetary Penalties Increase

On July 1, 2016, the U.S. Department of Labor (DOL) implemented the Inflation Adjustment Act of 2015. The act requires that civil penalties be adjusted to match that of the U.S. inflation rate. On January 17, 2023, the DOL announced new adjusted civil monetary penalties for 2023. The increases are small upward adjustments to the penalties assessed by the Office of Workers' Compensation Programs (OWCP) under the Longshore Act. 

New Civil Monetary Increases for 2023

Below are the new civil monetary increases for 2023 as stated by the DOL. 

Type of Violation Penalty (2023 Increase)
Failure to Report Termination of Payments $345
Penalty for Late Report of Injury or Death $28, 304
Discrimination Against Employees Who Bring Proceedings $14,149
